Founding partner Rusty Smith is a trial litigator with almost 20 years of complex and insurance litigation experience. Rusty was born and raised in Ardmore, Oklahoma where he learned from an early age the values of hard work and teamwork. A lifelong Sooner fan, Rusty graduated from the University of Oklahoma in 1999 and earned his law degree from OU in 2002. There, he met and married Toni Bradley Smith of Muskogee, who is now the Senior VP and General Counsel for Armstrong Bank and also the City of Muskogee Municipal and Juvenile Judge. Rusty and Toni live in Fort Gibson and are the proud parents of two intelligent, athletic, and active teenage boys.
Rusty has a unique trial practice that has long centered on complex litigation. A successful trial lawyer, Rusty has obtained several significant jury verdicts and appeals on behalf of both plaintiffs and private individuals/corporations. He has handled cases in nearly 70 Oklahoma counties, litigated in multiple federal jurisdictions over several states, and argued on multiple occasions at the United States Court of Appeals for the Tenth Circuit in Denver.
In 2010 Rusty co-founded his own law firm in Muskogee where he began to handle a variety of complex and high-profile cases, several of which garnered media attention. After successfully and consecutively trying several cases to jury verdict and resolving many others for six and seven-figure settlement amounts, Rusty founded Rusty Smith Law Group, PLLC in 2018. The firm renovated and moved into a mid-century modern office building in downtown Muskogee in 2019 and added attorney Dan Medlock. In 2020, RSLG added attorneys James E. Walters and Larry D. Moore to the firm. Later in 2020 Rusty Smith Law Group officially merged with The Barkett Law Firm, rebranded as Smith Barkett Law Group.
With offices in Muskogee and Tulsa, Rusty now has over 19 years of experience as a trial lawyer specializing in representing victims of life-impacting accidents, catastrophic injuries, wrongful death, and various complex civil litigation matters.
Rusty is licensed to practice in all state jurisdictions in Oklahoma, as well as the United States District Courts for the Eastern, Northern and Western Districts of Oklahoma, the United States Court of Appeals for the Tenth Circuit, the Cherokee Nation Bar Association, and the Muscogee (Creek) Nation Bar Association. He is also a member of the Oklahoma Association of Justice and was a 2020 member of the associations’ board of advisors.
